Terms of transport

Definitions: The  Carrier refers to Express Equine Europe

 

1.                 The Carrier is not a common carrier and only deals with animal / goods subject to these conditions. No agent or employee of the Company has the Company’s authority to alter or vary these conditions. 

2.                 In accordance with EU regulations each horse must be accompanied by passport while in transit. If The Carrier arrives to collect a horse and subsequently find that there is no passport, there will be a full charge for all expenses incurred.

3.                 Terms are cash on delivery. For journeys outside the UK a booking deposit of 10% per horse plus a further 40% of cost on collection of horse will be charged. Balance to be paid on delivery.

4.                 Any contract cancelled within 24 hours of departure will pay 50% of costs. Any contract cancelled within 12 hours of departure time may be charged full amount of costs.

5.                 The Carrier reserve the right to refuse to transport a horse if it is deemed unfit to travel or if we believe that the horse is likely to injure itself, another horse or handler.

6.                 General Lien – The Carrier (the Carrier) shall have a general lien against the owner or owner’s agent for any monies unpaid and/or costs incurred. If such monies or liabilities are not paid or satisfied within a reasonable time The Carrier shall be at liberty in its total discretion to sell any such goods as agent for the owner or owners thereof and to apply the proceeds of the sale towards payment of all monies or liabilities. Failure to deliver within the specified time period due to the exercise of the carriers lien shall not entitle the owner or owners  to withhold payments of any of the carriers charges.

7.                 The Carrier shall not be liable for any late delivery due to road, sea or loading conditions.

8.                 The owner/owner’s agent warrants that each horse in the consignment has been properly described and does load and travel without concern.

9.                 Horses and goods are accepted by The Carrier solely at the risk of the customer and The Carrier its servants and agents shall be under no liability in contract tort or otherwise for the death illness escape of or injury to any horse and damage to any goods from whatsoever cause arising nor for any loss or damage suffered by the customer or anyone claiming though him by reason of anything done or omitted to be done by The Carrier its servants or agents in connection with such horse/s or goods nor shall The Carrier  be under any liability for any delay or consequential loss or loss of market however caused. Whilst every care is taken, all horses are carried at the owner’s risk. Unless otherwise informed in writing The Carrier assume that horses carried are fully insured.
